The following terms and conditions govern use of www.espresso.ae (hereinafter referred as ‘The Website’), its content, services and all products available at or through the website (taken together, the "Website"). The Website is owned and operated by Mood Espresso. (Hereinafter referred as ‘Mood Espresso’), a sole properitorship formed under the laws governing United Arab Emirates. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this site collectively, may be referred to as the ‘Terms of Service’.
The Website is intended to be used only by individuals who are at least 13 years old. If you find a page within the Website that you believe violates our terms of service, please get in touch with us through any of the ways listed at mail at email@example.com
By accessing or using any part of the Website, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may stop using the Website or use discontinue any of its services.
If you create an account on the Website, you are responsible for maintaining the accuracy of data of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify Lifestyle Nutrition of any unauthorized uses of your account or any other breaches of security. Lifestyle Nutrition will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
All the Products are governed by the terms of warranties provided by the respective manufacturer/ brands. However, Lifestyle Nutrition may offer additional warranty and those shall be specifically mentioned along with the product details – if applicable.
Mood Espresso provides free shipping on orders made through ‘The Website’ when the invoice value is above AED 100/- subject to a condition of delivery location being within normal city limits within UAE. For orders below AED 100/- the customer may have to pay an additional surcharge of AED 20 per shipment. Unless otherwise mentioned, as per the company's policy, the shipping charges are to be borne and paid by the by purchaser in addition to the product price.
The Company reserves the right to waive off the free delivery clause, if the delivery location is not normally serviceable by our delivery partners. In case of such an event, we would normally try to contact the customer to get an alternate shipping address that is in a serviceable region. Failing to do so will make the order null and void. In such cases Mood Espresso, will not be responsible for the non-delivery of the product. Depending on the mode of payment, we will refund the amount, as a cheque if the location listed is not serviceable.
In case the customer orders multiple products in one transaction, Mood Espresso would make every effort to ship them together. However, this may not be always possible due to some product availability and/or logistics related issues. In such case, Mood Espresso may ship the order in parts - separately to the delivery addresses that you have mentioned while making the order.
The Website is not intended to serve as a catalogue of Mood Espresso’s retail outlet pricing. The price of similar products offered on the website may vary from those that is offered at the retail outlets of Mood Espresso. The Website strives to provide the best prices possible on all the listed products. However, Mood Espresso does not guarantee that the price will be the lowest in the city, region or geography. Prices listed online and availability of products is subject to change without notice or any consequential liability.
There may be certain orders that Mood Espresso may have to cancel, even after the customer makes the order. Mood Espresso reserves the right, at its sole discretion, to refuse or cancel any order without stating a reason whatsoever. Some situations that may result in your order being cancelled include without limitation non-availability of the product or quantities ordered the customer, delivery service falling outside the normally serviceable area, inaccuracies or errors in pricing information, or problems identified by Mood Espresso's credit and fraud avoidance department.
In case of requests for order cancellations, Mood Espresso reserves the right to accept or reject requests for order cancellations for reasons whatsoever. As part of usual business practice, if Mood Espresso receives a cancellation notice which has not been processed / approved, then Mood Espresso shall cancel the order and refund the entire amount within a reasonable period of time. Mood Espresso will not be able to cancel orders that have already been processed. Mood Espresso has the full right to decide whether an order has been processed or not.
Mood Espresso or ‘its representatives may also require from the customer additional identity verification before honoring the order done via credit or debit card. Mood Espresso or its representatives may contact you if all or any portion of the order is cancelled or if additional information is required to honor your order.
Before accepting shipment of any product, the customer who made the order is requested to ensure that the product's packaging or the product in itself is not damaged or tampered and that it matches the order that was made on the Website.
In the event, you receive a damaged / defective product or a product that does not comply with the specifications as per your original order, You are required to get in touch with the nearest Mood Espresso customer service department via email at firstname.lastname@example.org by quoting the order number and order details.
- Please notify online customer service and deliver the product at the nearest Mood Espresso Retail outlet along with the receipt of a damaged/ defective product/service within 48-hours of delivery.
- If You are unable to do so within 48-hours, Mood Espresso shall not be held liable for the failure to replace the order;
- Products should be unused; and should be returned in their original packaging along with the original price tags, labels, barcodes, user manual, warranty card and invoices etc.;
- The returned products are subject to verification and checks by Mood Espresso in order to determine the legitimacy of the complaint/ return.
- In the event the return of a product is duly accepted by Mood Espresso, the value of such product, as originally paid by the purchaser during acceptance of delivery of product or otherwise, will be refunded.
- All Refunds will be processed via cheque, by Mood Espresso
Mood Espresso do not arrange for collection of products from purchaser’s location. Mood Espresso customer service department may arrange collection of the products shipped at the nearest retail outlet – on its discretion, if the reasons stated are genuine and within the scope of exchange.
If the product was damaged on arrival- to the extent it is not usable, we try to get it replaced claiming through the genuine manufacturer’s warranty. (Conditions apply).
You agree to indemnify, defend and hold harmless Mood Espresso from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Mood Espresso that arise out of, result from, or may be payable by virtue of, any breach of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to these Terms of Service or any Additional Terms applicable to the purchase of products and services on the Website.
In no event shall Mood Espresso , its officers, directors, employees, partners or vendors be liable to you, the Vendor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Mood Espresso has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortuous action, or any other claim arising out of or in connection with your purchase of the products and services herein. Notwithstanding anything to contrary, Mood Espresso entire liability to You under this Terms of Sale or otherwise shall be the refund of the money charged from you for any specific Voucher or product or service, under which the unlikely liability arises. Mood Espresso shall not assume any liability for the non-availability of the product, non-delivery of the product or inaction that might be taken by the Vendor after issue of the Voucher to the User.
You agree that all claims, differences and disputes arising under or in connection with or in relation to the Terms of Sale or any transactions entered into on or through the Website (espresso.ae ) between You and Mood Espresso shall be subject to the exclusive jurisdiction of the courts at Dubai, United Arab Emirates and the users of this site hereby accede to and accept the jurisdiction of such courts.
